President Biden and his longtime advisers will likely face harsh criticism but will be cleared of liability and will not face criminal charges for their withholding of classified material dating back to the commander in chief’s time as a U.S. senator from Delaware.
Special counsel Robert Hur’s team is preparing a report on its months-long investigation that is expected to be highly critical of the handling of sensitive materials by the 80-year-old president and his staff, but is not expected to charge anyone. over the matter, CNN said and the Wall Street Journal reported Thursday.
The extensive report could be published before the end of the year and is expected to go into significant detail about what Hur’s team discovered in the course of their investigation. Hur, aware that his report will be examined, would have been scrupulous in conducting interviews with anyone who had been close to the classified material.
Once the report is released, the Justice Department will likely make Hur available to answer questions from congressional lawmakers, many of whom have cast doubt on Biden’s explanation of the chain of events that led to the discovery of more than a dozen classified documents.
The result is not at all surprising, since the Justice Department has a long-standing policy of not indicting a sitting president on the grounds that it would “undermine the ability of the executive branch to perform the functions assigned to it by the Constitution.”

Hur, a former Trump appointee, was appointed special counsel by Attorney General Merrick Garland on Jan. 12 to investigate the matter of Biden’s classified documents.
Almost exactly two months earlier, Garland had hired Jack Smith as a special prosecutor to investigate former President Donald Trump’s hoarding of national security material at his Mar-a-Lago resort.
Smith’s team has since filed 40 charges against the former president in that case.
Biden sat down for a voluntary interview with Hur on at least two occasions last month, the White House previously confirmed.

As Hur’s investigation into Biden draws to a close, House Republicans have already begun signaling plans to ramp up pressure on the classified documents scandal.
Earlier this week, House Oversight Committee Chairman James Comer (R-Ky.) subpoenaed former White House counsel Dana Remus for information on the matter.
Comer is leading a three-committee impeachment inquiry into Biden that has largely focused on the first family’s foreign business machinations.
Last month, Comer indicated that his Oversight Committee is examining the status of the documents and pointed out alleged gaps in the White House’s timeline of events.

In January, the White House confirmed that Biden’s personal lawyers discovered classified material in his post-presidential office at the Penn Biden Center for Diplomacy and Global Engagement in Washington the previous November, days before the midterm elections. .
CNN reported at the time that about 10 classified documents, some marked “top secret,” related to the United Kingdom, Ukraine and Iran were found.
Other classified documents were recovered from Biden’s home in Wilmington, Delaware, where images of Hunter Biden’s abandoned laptop show a beat-up box of “Important Doc’s” and indicate that Hunter had access to the family garage where the documents were kept, not far from where Biden stood in 1967. Corvette Stingray was parked.
The White House did not immediately respond to a Post request for comment.
