Vaiko was jailed for 40 days on charges of organizing a black flag demonstration against former Prime Minister Indira Gandhi’s visit to Tamil Nadu in October 1977, and for over a year in 1976-77 during the Emergency. He has been arrested on numerous occasions for protests, particularly during the anti-Hindi agitations of 1986-1987.
He was elected to the Rajya Sabha in 1978 and has served three terms in the Upper House. Furthermore, he was elected as a member of the Lok Sabha thrice. Vaiko founded MDMK in 1993 as a result of disagreements with Karunanidhi. Due to his vehement comments in Parliament, Vaiko earned the nickname “Lion of Parliament”. Vaiko opposed Kerala’s proposal to build dams at Siruvani and Pambar as well as its demand for a new dam at Mullaperiyar. Vaiko also supported the construction of the Sethusamudram shipping canal and the national river interconnection. Vaiko filed a public interest litigation (PIL) in the Madras High Court seeking closure of Sterlite Industries’ copper smelting factory in Tuticorin because it was not complying with proper waste management protocols, which ultimately led to the closure of plant.
Vaiko frequently leads party members on foot marches to draw attention to problems. Vaiko openly supported the LTTE and other groups fighting for a separate Tamil Eelam state in Sri Lanka. He visited Eelam in 1989 during the height of the conflict between the LTTE and the Sri Lanka Army, while the Indian Peace Keeping Force IPKF was stationed in Jaffna. Vaiko was the first person detained in the country under the Prevention of Terrorism Act 2002 and a leader of a recognized political party. After serving 18 months in prison, he was released.

Vaiko was released after 14 days. According to Vaiko, India should lift its embargo on the LTTE because they were used as a shield to suppress freedom of expression and the voice of the opposition.
Vaiko was jailed on April 3, 2017, as a result of a sedition case filed by DMK by the administration in 2010. Vaiko’s suit alleges that India’s sovereignty has been violated. Vaiko received a prison sentence in 2009 and served 56 days of that sentence. Vaiko was sentenced to one year in prison and a $10,000 fine. Vaiko filed an appeal against the ruling a few days after it was issued. Judge Adikasevalu ordered the suspension of Vaiko’s sentence after hearing her appeal.
