On Tuesday, the Bombay High Court rejected a petition. This petition called for a ban on Indians, companies and groups from working with Pakistani artists. These artists include actors, singers, musicians, lyricists and technicians.
Justice Sunil B Shukre and Justice Firdosh P Pooniwalla headed the bench.
What did the petition say?
They said the petition represented a “retrograde step in promoting cultural harmony, unity and peace” and was without merit.
The person who filed the petition works in the film industry. They had sought instructions from the Ministry of Information and Broadcasting, Ministry of External Affairs and Ministry of Home Affairs to ban Pakistani artists and limit their visas.
The court noted that the Indian government’s efforts to promote global peace and security, such as allowing Pakistan’s cricket team to join the Cricket World Cup in India, would be harmed if it considered such petitions. Live Law reported this.
The court also mentioned that activities such as arts, music, sports, culture and dance, which promote peace, unity and harmony, go beyond national boundaries and help build unity and harmony within and between countries.
When and why was the ban imposed?
In September 2016, the Indian Movie Producers Association (IMPPA) decided to ban Pakistani actors from the industry after the Uri attack.
TP Aggarwal, president of IMPPA, had stated:“(The) IMPPA in its 87th annual general meeting passed (a resolution that) no Pakistani will be employed by its producer members forever.”
The court said the petitioner’s request for policy guidelines was not something it could do because it could not tell the government or the legislature how to create policy.
As a result, Live Law reported that the petition was rejected.
Pakistani actor Fawad Khan acted in two Dharma productions, “Kapoor and Sons” and “Ae Dil Hai Mushkil”, while Mahira Khan appeared in Shah Rukh Khan’s film “Raees”. Singers like Atif Aslam and Rahat Fateh Ali Khan have sung in Indian films before.
