Airline failed in agreement with Patriots and was about to ground the team: lawsuit

They should have called the New York Jets.

The New England Patriots are suing Eastern Airlines for more than $22 million after the company attempted a solution: allegedly charging more to fly the team just before the start of the preseason.

The Pats claim they were intentionally punished when Eastern, which went bankrupt in 1991 but whose rights were purchased in 2018 by a charter operator, tried to pressure the team to renegotiate the terms of the trip.

“If he [New England Patriots] did not pay Eastern more than was provided for in the parties’ agreement, Eastern would simply withdraw from the agreement, leaving the Patriots without an aircraft operator on the eve of the next NFL season, and without any plan to transport the Patriots . a sizable contingent of players, coaches and other personnel across the country,” a breach of contract lawsuit alleges.

Eastern gambled and lost, says the lawsuit, filed Tuesday in Manhattan Federal Court. The team rejected the higher charges and terminated the agreement entirely.

The Patriots are seeking $22.8 million, plus additional damages and attorney fees, citing Eastern’s attempt to “obtain additional non-negotiated compensation” through the ultimatum.

The lawsuit was also filed by 02/25/94, a Massachusetts company that leased two Boeing 767s to Eastern to transport the Pats for six NFL seasons. The deflated agreement between Eastern and the parties was just two seasons before they dropped the ball.

One Mile at a Time called Eastern “the world’s strangest airline” in a blog post last year. The airline has repeatedly announced new routes, only to cancel them, he noted.

Eastern and the Patriots did not immediately respond to a request for comment.
