Hoosein Mohamed, a former director of Arthur Kaplan, was not granted bail on Thursday at the Randburg Magistrate Court. This came after his arrest on June 1 following an altercation in Sandton, where he is accused of pushing liquidator Laila Motala against a wall and brandishing a gun. The court is not satisfied that the applicant has established beyond a reasonable doubt that it would be in the interest of justice to grant bail. After a request for extended bail, Magistrate Liesl Davis stated that the request was denied. Since her appointment as interim trustee in December, Motala, the daughter of notorious trustee Enver Motala, has been winding down the luxury jewelry line.

Mohamed has been accused of twice assaulting a person in connection with the liquidation. Thulani Ngubane, an employee of Arthur Kaplan, was also attacked but no longer faces prosecution. Motala highlighted the cold-blooded murder of renowned trustee Cloete Murray and his son, Thomas, in sworn statements filed in court in support of the state’s resistance to posting Mohamed’s bail. Following the encounter with Motala, Mohamed now faces seven charges, including two counts of aggravated assault and two counts of brandishing a firearm. To ensure that creditors are paid and to ensure that business owners do not have hidden assets that they can sell at a later time, liquidators must locate all assets owned by a business in liquidation. According to Motala’s statement, read out in court by her lawyer Ian Small-Smith, Mohamed attacked her client in a fit of “unprovoked anger” on June 1 as she was on her way to the Sandton branch.
