New York Attorney General Letitia James on Tuesday filed a motion asking a judge to impose legal sanctions on former President Donald Trump, his children and his legal team for “frivolous conduct” in their $250 million fraud lawsuit against him and his company.
James argued that Trump, 77, and the other defendants should be collectively ordered to pay $10,000, and his lawyer an additional $10,000, for repeatedly using legal arguments that have already been dismissed on several occasions by the judge overseeing the case. , according to court documents.
“The Court has the discretion to ‘impose financial sanctions on any party or attorney in a civil action or proceeding who engages in frivolous conduct,’ and may impose sanctions against both,” the attorney general’s office argued in Tuesday’s filing before the Manhattan Supreme Court.
“In this case, the lack of legal basis for defendants’ standing, capacity, disclaimer, and return arguments should have been evident to defendants and their attorneys from the prior rulings of this Court and the First Department.” , the motion continues. “In these circumstances, the Court should impose sanctions against the defendants and their lawyers.”

Trump argued in October 2022 that the attorney general’s office had no right to bring the sweeping lawsuit against him, his firm, the Trump Organization, and his sons Eric and Donald Trump Jr., but that motion to dismiss the case was defeated by the Manhattan Supreme Court. Court Judge Arthur Engoron.
Engoron rejected a second November 2022 motion to dismiss that used the same three arguments, finding them “almost frivolous even the first time the defendants raised them,” adding that the “sophisticated defense attorney should have known better.” , argued the attorney general.
The judge also warned that Trump’s team could face sanctions by rejecting the second motion to dismiss, but did not impose any at the time.
The attorney general’s office said those same arguments were used again by the Trump team in presentations on at least three other occasions on February 7, August 4 and September 1 of this year. The two most recent motions have not yet been decided.
James, 64, has requested $10,000 collectively from the defendants and $10,000 collectively from all of his attorneys.
James’ staggering 220-page lawsuit from September 2022 claims the former president “grossly” inflated his net worth by billions to fool lenders with misleading financial statements.
The lawsuit seeks to curb Trump’s ability to run businesses in New York and bar him and his team from buying commercial property for several years.
“Donald Trump falsely inflated his net worth by billions of dollars to unjustly enrich himself and cheat the system, thereby deceiving us all,” James, a Democrat, said at a news conference at the time.
James’ office filed the staggering 220-page lawsuit against the Trump family in September 2022, alleging that the former president and his Trump Organization fraudulently inflated the value of their assets – including their homes and golf courses – to obtain loans and fiscal benefits. PA
“Claiming that you have money you don’t have isn’t the art of a deal, it’s the art of stealing,” he said, referring to Trump’s 1987 book.
James’ office, which investigated the Trump family for three years, said they have uncovered possible criminal violations, including falsification of business records, insurance fraud, issuance of false financial statements, conspiracy and bank fraud.
