Ramdular Gaur, Bharatiya Janata Party (BJP) Member of Legislative Assembly (MLA) from Duddhi constituency in Uttar Pradesh, has been convicted by the Duddhi Additional District and Sessions Court for the rape of a minor 9 years ago. The Additional District and Sessions Judge of Sonbhadra (Uttar Pradesh) sentenced Ramdula Gaur to 25 years in jail and imposed a fine of 10 lakh. Additional district and sessions judge MP-MLA Sonbhadra also ordered that the fine be transferred to the girl’s family for her rehabilitation.
BJP MLA found guilty of raping minor
Ramdular Gaur has been convicted by the Uttar Pradesh Additional Sessions Court for the crime of rape and threatening dire consequences against his younger sister. The conviction has paved the way for the Bharatiya Janata Party (BJP) leader to be disqualified from the Duddhi assembly seat in Uttar Pradesh. The law provides that a person sentenced to a prison term of two years or more is disqualified from the date of conviction and remains disqualified for an additional period of six years after serving the sentence. Gaur, a member of the Scheduled Tribe (ST), was elected to the Uttar Pradesh legislature from Duddhi assembly seat in Uttar Pradesh in 2022.
Ramdular Gaur was found guilty by the court on December 12. Special public prosecutor Satyaprakash Tripathi said the court had registered a case against the member from Duddhi Assembly constituency. Before the verdict was pronounced, Ramdula Gaur’s lawyer asked the court to award him the minimum sentence. He also said Gond will provide full support to the rape survivor’s family. Tripathi said that due to the details of the case, the case was registered on November 4, 2014. He added that the case was registered under sections 376 (rape), 506 (punishment for criminal intimidation), 5L/6 and Protection of Children against Sexual Offenses (POCSO).
The incident took place when Ramdular Gaur’s wife was Gram Pradhan, he said. The case was registered by the Myorpur police based on the complaint of the victim’s brother. At that time, Ramdul Gaur was not an MLA and the case was in the process of being tried in the Public Interest Ombudsman (POCSO) Court. However, after he was elected MLA, the case was transferred to the Maharashtra Pradesh Congress Committee (MP-MLA) court. Duddhi Assembly constituency is one of the five Assembly constituencies that make up the Robertsganj Lok Sabha constituency, which is reserved for Scheduled Tribe candidates.
