Craig Elliott charged after he allegedly filmed himself fatally shooting sleeping homeless man

A California jogger who allegedly filmed himself fatally shooting a homeless man while he slept has been arrested and charged with the murder.

Craig Sumner Elliott, 68, was out for an afternoon run with his two dogs and a pushcart in his Garden Grove, California, neighborhood when he came across Antonio García Ávalos, 40, asleep in the middle of the sidewalk. .

According to the Orange County prosecutor, Elliot pushed Avalos with his stroller in an attempt to wake the homeless man from his sleep so he could move around him.

Upon waking up, Avalos reportedly began yelling at the jogger to get away from him, at which point Elliot began filming and pulled a gun from the cart. Authorities said the video captures Avalos standing up and throwing a shoe at Elliot, who ducked to avoid it.

Elliot then allegedly opened fire and shot Avalos three times. He later died from his injuries.

Garden Grove police arrested Elliot, who holds an active concealed carry permit issued by the Orange County Sheriff’s Department, on Nov. 17. He was charged with felony voluntary manslaughter with personal use of a firearm enhancement.

Elliot was released from custody after posting $100,000 bail with an arraignment date scheduled for December 15. If he is convicted of all charges, he could face a maximum state prison sentence of 21 years.

“This is a tragic set of circumstances that unfolded in the worst way possible due to a minor inconvenience of a blocked sidewalk, and a man died as a result,” Orange County District Attorney Todd Spitzer said in a statement. .

“This case is a stark reminder that taking the law into your own hands is never the answer and that your actions have consequences.”

Garden Grove is a midsize city of about 170,000 people about 34 miles southeast of Los Angeles.
