WASHINGTON – A Republican senator wants D.C. to notify states before sending migrants from the US-Mexico border to other jurisdictions.
“Americans deserve to know who is being pushed into their communities at the expense of taxpayers,” Sen. Roger Marshall (R-Kan.) exclusively told the Post.
The National Oversight of Immigrants Transported to Communities is Essential (NOTICE) Act, which Marshall introduced Thursday, would require federal agencies to provide states with key information about migrants whom the government transfers to their locations.
“The Secretary of Homeland Security and the Secretary of Health and Human Services shall notify the governor of a state and the chief executive officer of a local government unit in such state of any alien who is being transported by… entity[ies] receive federal funds for such transportation from a location within 100 miles of the United States border,” the legislation says.
The required information, which will be sent before any migrant leaves, would include name, age, sex and country of origin, criminal history and disclosure of whether the individual has been or is associated with a gang, according to a copy of the legislation. obtained by The Post.

Additionally, agencies would have to disclose “the types of security checks that have been performed” on migrants, according to the bill.
The legislation comes as New York, Washington, D.C. and other liberal places face a surge of migrants as border states like Texas bus into their jurisdictions.
“You would think that when you have Democratic governors in deep blue states like Illinois and New York complaining about the strain and cost that transporting migrants has had on their states, this administration would begin to show some willingness here in Washington to secure the border, But it’s not like that,” Marshall said.
In September and October 2022, at least two migrant flights carrying more than 25 minors arrived at the Orange County Airport in Montgomery, New York, from El Paso, Texas. The mayor of the upstate village criticized Biden at the time, calling the operation “clandestine.”
“We were never informed of any flights arriving at the airport,” Montgomery Mayor Steve Brescia told The Post. “It’s just concerning that we haven’t been informed of any of this.”

The migrants were sent to 12 locations, including children’s homes and shelters spread across suburban areas of the tristate and New York City.
Despite criticizing Texas Governor Greg Abbott and Florida Governor Ron DeSantis for sending migrants north, the Biden administration has been conducting such secret flights since at least last year.
“Joe Biden’s border crisis has made every community in the country less safe,” Marshall said. “Nothing about the invasion on our southern border is compassionate, it is certainly not safe, and it is absolutely unsustainable.”
The notification requirement would only apply to migrants sent by the federal government. No such information is required on newcomers sent by states or privately funded groups.
