Hunter Biden was charged in more ways than one in October 2018, federal prosecutors alleged Tuesday in a scathing response to the first son’s attempt to dismiss weapons charges against him.
Five years after Hunter’s sister-in-law-turned-lover Hallie Biden, now 53, dumped Hunter’s firearm in a trash can behind a Delaware grocery store, FBI officials re-examined the gun. .
Agents removed the sealed Colt Cobra 38SPL revolver from a state police vault to photograph the weapon sometime last year and found white powder in the bag containing the weapon, a court filing by special prosecutor David Weiss revealed.
“An FBI chemist later analyzed the residue and determined it to be cocaine,” the 52-page document said.
“To be clear,” the prosecution’s motion adds, “investigators literally found drugs in the bag where the defendant had kept his gun.”

Weiss’ team was responding to a motion to dismiss weapons charges filed by Hunter Biden’s lawyers last month.
In the rebuttal, Weiss’ team recounted the evidence they had to confirm that the troubled first son was using illicit drugs at the time he completed a background check to purchase the gun and claimed that he was not addicted to any illicit substances, committing a federal crime. in the process.
Elsewhere in the rebuttal, prosecutors referenced Hunter Biden’s 2021 memoir, “Beautiful Things,” in which he “made countless incriminating statements about his years of drug use.”
“The defendant’s decision to sell a book containing these confessions not only strengthened the government’s case against him, but also increased the overall deterrent value of a potential indictment,” Weiss’ team wrote.

Prosecutors noted that Hunter Biden moved forward with writing the book after he learned that local authorities had recovered the gun from an elderly man who was sorting recyclables from the trash can and that a federal investigation was underway into the matter. .
They also pointed to messages, including ones Hunter exchanged with Hallie, who had discarded the gun about 11 days after purchasing it.
Hunter Biden’s legal team, led by attorney Abbe Lowell, claimed Weiss bowed to “political pressure” by filing the firearms charges in Delaware.
Last July, Hunter Biden was set to sign a jail-free plea deal for two misdemeanor counts of willful failure to pay taxes and entering a federal firearms felony diversion program.

But the agreement imploded during a dramatic court hearing once it became clear to the first son’s lawyers that the agreement was not intended to provide blanket immunity from prosecution for other crimes.
A month later, Attorney General Merrick Garland granted Weiss, the U.S. attorney for Delaware, special counsel status.
Hunter now faces three federal felony firearms charges for this ordeal.
Additionally, he has three felonies and six misdemeanors pending against him in Los Angeles for allegedly evading $1.4 million in taxes between 2016 and 2019.

“According to the facts and the law, if Hunter’s last name was anything other than Biden, charges would not have been filed in Delaware, and now in California,” Lowell said last month.
Prosecutors disputed the defense attorney’s claim Tuesday.
“Contrary to your assertion, you have not established that the Special Counsel, appointed by President Biden and his Attorney General and acting at his will, is punishing the defendant ‘for the alleged sins of his father’ to capitulate to a former President for his tweets,” said Weiss’s team.
“This theory is a fiction designed for a Hollywood script.”

Hunter Biden has used his drug addiction and recovery efforts (he now claims to have achieved sobriety) as a cudgel against legal and congressional scrutiny.
“My struggles and my mistakes have been fodder for a vile and sustained misinformation campaign against [President Biden]and a complete annihilation of my reputation through sharp but fruitless Congressional investigations and, most recently, criminal charges for possession of an unloaded gun for 11 days five years ago, charges that appear to be the first of their kind filed. in Delaware history,” he wrote in a USA Today op-ed last year.
Lowell’s firm did not immediately respond to a request for comment.
Last month, Hunter Biden refused to testify before the GOP-led House impeachment inquiry, defying a subpoena after demanding a public appearance, which Republicans refused.
He is now reportedly in negotiations to appear before the House Oversight and Judiciary committees.
