Ivanka, who was not in court Friday, was originally a defendant in New York Attorney General Leticia James’ $250 million lawsuit against her father and the Trump Organization, but a state appeals court dismissed it as accused in June.
Engoron ruled that the former president’s daughter would not take the witness stand before Wednesday, giving her the opportunity to appeal his decision.
The judge made his decision after Ivanka’s lawyers filed a motion against the measure, arguing that she should not be forced to testify after the appeals court ruling.
Ivanka’s attorney, Bennet Moskowitz, argued that Ivanka has not lived or done any business in New York since 2017 and offered to produce an affidavit signed by Ivanka to confirm this.

Engoron asked for a brief pause before siding with the state in its ruling.
