Bryan Kohberger is accused of murder, and the prosecution claims that his defence team is seeking to “grind the litigation” to a “halt” with thin arguments and “buy more time” to contest his accusation. In a court document filed on Monday, prosecutors stated that Kohberger’s defence team had asked for a stay by “raising allegations of technical violations without ever explaining how any reach the substantial’ standard set forth” in Idaho’s jury selection process statute. Kohberger is a former doctoral candidate who is accused of killing four college students last year. The defence attorneys for Kohberger argued that the provision did not apply to their case or that they had misinterpreted it, according to the prosecution.
Kohberger, they continued, “has delivered on his promised strategy: he wants a stay to buy more time to challenge the charges in this case.” In July, Kohberger’s legal team asked that the case be put on hold for a second time, citing an “apparent failure” in the grand jury procedure. Without providing any other details, defence attorney Anne Taylor stated that “another irregularity exists within the procedure for grand juries and further inquiry is necessary to determine the impact, if any, on the convening of this grand jury.” The defence’s allegations of “failure” in the selection process were itemised and addressed by the prosecution in a filing made on Monday.
The prosecution argued that Kohberger’s team has “not factually asserted a substantial failure to comply” with the jury selection procedure, adding that it has long been obvious that they were “determined” to obtain a stay even before they had access to any of the grand jury papers that could support their claims. Before receiving the grand jury files that would serve as the foundation of their challenge, the defence had asked for a break in the proceedings in June. This request was turned down. Ethan Chapin, 20, Madison Mogen, 21, Xana Kernodle, 20, and Kaylee Goncalves, 21, were all University of Idaho students when they were killed. Kohberger is accused of killing all four of them. He might receive the death penalty if found guilty.
