Legal battle over chicken-free Biryani results in compensation for customer

After a surprise encounter at a dinner party, a Bengaluru man took a local restaurant to consumer court.

According to The Times of India, the man, known as Krishnappa, sued the restaurant for serving “chicken biryani without chicken.”

In response, the city court ordered the restaurant to pay the consumer Rs 1,000 for mental suffering and refund Rs 150 for the meal.

When did it happen?

The incident occurred in April this year, when Krishnappa visited the restaurant with his wife due to a lack of gas for cooking at home. They took the food packet home after ordering chicken biryani. When they opened it, they discovered that the biryani rice contained no meat.

Krishnappa immediately called the restaurant to resolve the matter.

Why did the man decide to do it?

According to Krishnappa, even though the restaurant owner promised a replacement order within minutes, it did not materialize even after a two-hour wait, and calls to the restaurant went unanswered.

He took matters into his own hands, serving a notice at the restaurant and sending legal documents, frustrated by the lack of resolution. He got no response from the owner.

In May, Krishnappa decided to take the dispute to the Bengaluru Urban District Consumer Disputes Redressal Commission. In his complaint, he wanted Rs. 30,000 in compensation for the surprise eating experience.

How did you win the case?

Without a lawyer, the Bengaluru man displayed images of the meatless biryani, underlining the mental anguish he and his wife felt as a result of not being able to cook that day.

Acknowledging his point, the judges ruled in Krishnappa’s favor and found that the restaurant had, whether knowingly or innocently, made a mistake by not providing the customer with the requested services.

As a result, the court ordered the restaurant to refund the customer’s money.
